Have you ever had one of those days where nothing went right? No matter how well you planned things out? On the evening of February 2nd, my wife and son set out to drop me off at a close friend’s business launch. He was inviting business partners to review products and celebrate the progress his business had made. My 1 year old son became car sick and we turned around. My wife encouraged me to continue on & be supportive. That evening I made arrangements to still attend the launch and connected with a local friend to stay close to event. After the event, I turned in around 12:30. The following morning I realized that my car keys and phone were missing from the evening before. Around 7:30 am I headed back to my home in Jordan to retrieve my spare set of car keys and let my wife know what was happening. My friend hosting the launch had offered me his vehicle so I could get home to speak to my wife. She had to have been worried at this point. I was rushing that morning to get home, I am fully responsible for that. I should have been more mindful of those around me by slowing down. When I was pulled over I answered the police’s questions. Yes, I had been out the night prior. I had slept that night and was on my way home.
Insert issue about how the test was administered. Time is fixed and the criticality of making the 2 hours. As Officer Flaten know the Data collection, needs to be done within 2 hours. He stated he is the data master so to make the test accurate he skew the test time for 3 mins to less than 1 minutes. Ensuring he get sample of shorter breath but equivalent not to the full test. The data of each test is the same but different lengthen of time. He could not wait 10 mins or more unlike the two previous test therefore he speeded up the data process. It the patterns of inconsistency...
The officer did not follow proper procedures to get an intake. First, he stated to blow but did not provide proper procedure/instruction to complete the test adequately. During the test he did not give me the opportunity to hold the test tube freely and perform the test. He held the tube with no use of PPE (personal protection equipment) for contamination purposes. This includes bodily fluid and other contaminates. He also inserted the mouth piece. As an officer you are given proper PPE to take samples. Secondly, he administered the test too many times. This resulted in 3 different results: deficient, invalid, and other. During the test he was actively intimidating me with refusal charges, and yelling at me. This resulted in myself becoming light headed due to his repeated commands to blow, blow harder, and yelling. The equipment is design to speak for itself. If the teste does not do the test proficiently the equipment will provide the data. After careful review of the equipment manual and watching the video, this was a bad test sample. Under the equipment function, if the test is not working properly it gives indefinite remark. The officer needs to be properly trained to administer the equipment to ensure this does not continue to happen. This needs to be dismissed as this was administered negligently. As a citizen he did not administer my right on how to provide correct sample. Providing written instruction.
I am completely aware of how drinking should be done carefully & thoughtfully. I have two teenagers that we speak on this all the time. Our actions impact those around us. After being stopped I took a course with MADD (mothers against drunk drinking) because I felt I needed to learn more about the effects of drinking and honestly to continue to be the role mode I want to be for my kids. As a parent, being irresponsible is not an excuse. I took all measures as a 40 year old adult to safely be there to support my friend’s launch. I took safety measures to be there for my family now and for as long as in my control. I do not think that this is an adequate charge or process on how this was handled.
